IX.QUALITY AND WEIGHT 质量和重量

A、Determination of Quality and Weight 质量和重量的测定

1、At the loading port, the SELLER shall conduct sampling and analysis based on JIS M8109-1996, the result of which shall be the basis for the issuance of Certificate of Quality (“COQ”) by the SELLER.在装港，卖方须按照JIS M8109-1996标准进行取样及化验分析，且其结果将作为卖方出具质量报告的基础。

2、At the discharging port, the BUYER shall, at its costs, hire the services of CCIC / COTECNA CHINA as independent surveyor to conduct sampling and analysis of the nickel ore based on JIS M8109-1996, the result of which shall be the basis of the issuance of COQ by CCIC / COTECNA CHINA.在卸港，买方承担费用，聘请CCIC/泰纳中国作为第三方检测机构以JIS M8109-1996对镍矿进行取样及化验分析，其结果将作为CCIC/泰纳中国出具质量报告的基础。

3、The basis of final quality shall be the COQ at discharging port issued by CCIC / COTECNA CHINA. However, if the CCIC / COTECNA CHINA COQ is not given within 60 days after B/L date or the Buyer fails to conduct sampling and analysis based on JIS M8109-1996, the SELLER’s COQ shall be regarded as final.最终质检报告须以装港卖方报告和卸港CCIC/泰纳中国卸港报告平均值为准，若在提单日后60天内CCIC/泰纳中国质检报告未能提交或买方未能按照JIS M8109-1996进行取样分析与化验，卖方的质检报告将会作为最终。

4、The B/L weight issued at loading port shall be used as basis for the computation for the final weight below: 装港的提单重量将作为最终的结算依据，公式如下（扣吨）

Final Weight = B/L Weight – [B/L Weight x (Final Moisture -35%)] 最终重量=提单重量 – [提单重量*（最终水分含量-35%）]
